The Justice mobile app (“App”) is owned and operated by Justice. Justice is part of Tween Brands, Inc. ("Justice" and "we," “our,” or "us"). As required by the Children's Online Privacy Protection Act ("COPPA"), we provide this privacy policy to inform parents and legal guardians (collectively, “Parents”) of children younger than the age of 13 (“Children”) and other App users about our privacy practices. This Privacy Policy only covers information collected through the App and does not cover information collected at any other Justice website, application, or online service (unless such service expressly posts a link to this Privacy Policy), nor to information collected offline by Justice.

 

Please review our full privacy policy below – but here are some key points to know:

 

  • The App does not require a Child to provide her name, address, or other contact information in order to download and browse the App.

 

  • The App, and its third-party service providers, may collect IP address and similar device identifiers – but only for analytical and other internal-operations purposes.

 

  • The App does offer users the opportunity to register an account and registered users may have the opportunity to submit or disclose Personal Information through the App, including the opportunity to post photos viewable by other App users. Before any user can register an account, we require her to provide contact information for her Parent, so that we may provide her Parent with notice of the information that may be collected from or disclosed by registered users of the App and obtain the Parent’s consent prior to collecting or disclosing any such Personal information.

INFORMATION THE APP COLLECTS AND HOW WE USE IT

 

Personal Information  

 

The App does not generally collect name, address, or other contact information from Children, other than the limited circumstances set forth below. However, we and our third-party service providers may collect information from Children that is considered “Personal Information” under COPPA in the following circumstances:

 

  • We collect IP address or other unique identifier that is associated, on a persistent or ongoing basis, with the mobile phone or other device used to access the App (“Device Identifier”). We, and our third-party service providers, use Device Identifier information solely to support internal operations, including maintaining, securing, and analyzing the functioning of the App.

 

  • Children may utilize a “send-to-a-friend” feature whereby the Child can instruct Justice to send App content (e.g., a “wish list” of Justice products that the Child has constructed using the App) to a designated recipient. To utilize such a feature, the Child is asked to provide only the recipient’s email address, and not the child’s name or email address or the recipient’s name. The communication sent to the recipient features only Justice content from the App; the Child is not given the opportunity to provide or disclose other Personal Information through use of the send-to-a-friend feature. Justice does not retain the recipient’s contact information after the message is sent.

 

  • In some instances, we may collect a Child’s email address for one-time use of that information, such as to respond directly to a specific request (for example, responding to a support request submitted through the App or allowing a sweepstakes entry). We delete the contact information provided from our records once it is used to fulfill the specific one-time purpose and will not use it to re-contact the Child;

 

  • The App allows a Child to register an account with the consent of her Parent. Even when a Child is permitted to register an account, the App collects or allows the disclosure of the Child’s Personal Information only in limited additional circumstances. The App does not permit Children (including those who register an account) to post or send “free-text” messages. However, registered users of the App do have the ability to (a) elect to receive push notifications from the App and (b) create and share photo and video posts that are viewable by other App users. These photos and videos may include information that, for Children, is considered Personal Information, including a photo or video of the Child and additional Personal Information as may be audible or visible in the photo or video. These posts do not allow the Child to include a free-text caption or other message, unless visible within the photo or video itself. When a Child posts a photo or video, Justice will send an email to the email address then on file for that Child’s Parent. The Parent may then elect to delete the post or may choose to delete the Child’s App account entirely by following the links and instructions provided in that email. For more information about the ability of a Parent to access and delete Personal Information that we have collected about his or her Child, please see the Parent’s Rights/Content Removal section

 

  • We may in the future collect a Child's name and email address to the extent reasonably necessary to protect the security of our App, to protect against liability or as required or permitted by law. We do not collect a Child’s name and email address for these purposes in the ordinary operation of the App. In the event that we collect information for these reasons, we will not use it for any other purpose.

 

Please note that, as required by COPPA, we will not condition a Child's participation in an activity within the App on the Child disclosing more than is reasonably necessary to participate in such activity. We use Personal Information only for the purpose for which it was collected and for internal purposes. We retain Personal Information collected from a Child only for as long as is reasonably necessary to fulfill the purpose for which the information was collected.

 

Usage Information

 

In addition, we and our third-party service providers may use a variety of technologies that automatically or passively collect certain information whenever a user operates or interacts with the App ("Usage Information"). This is typically collected through a Device Identifier for your device.  Usage Information may include the device type and operating system you are using, all of the areas within our App that you visit, and the time of day, among other information. Usage Information is typically associated with your Device Identifier. We may use Usage Information for a variety of purposes, including enhancing or otherwise improving the App and our products and services.

 

DISCLOSURE OF COLLECTED INFORMATION

 

We do not release a Child's Personal Information to third parties except: (a) where the disclosure is reasonably necessary to comply with law, respond to civil or criminal action, or to protect the security of the App or other properties owned by Tween Brands, Inc.; and (b) to service providers who provide support for the internal operations of the App and who do not disclose or use the Personal Information for any other purpose. These service providers may provide support services such as hosting the App, designing and/or operating App features, or performing other administrative services. Justice may provide these companies with access to Children’s Personal Information in order for them to carry out the services they are performing on Justice’s behalf. These service providers have agreed to maintain the confidentiality, security and integrity of this Personal Information they obtain from Justice and the App. We also may share Usage Information that does not contain any Personal Information (such as aggregated user statistics) with third parties.

 

PARENTAL CONSENT & INFORMATION COLLECTED FROM PARENTS

 

A Child is allowed to register an account with the App only if his or her Parent consents. To contact Parents to provide notice and obtain consent for the Child to register, the App requires the Child to provide online contact information (e.g., an email address) for his or her Parent at the outset of the registration process. If a Parent consents, (s)he will be required to provide additional Personal Information during the consent process, including his or her full name, street address, date of birth, and other information that may be required in order to help us confirm the that the consent process is being completed by the Parent.  Information collected from Parents is collected outside of the App and is subject to Justice’s website privacy policy, available at http://justicetweenbrands.custhelp.com/app/answers/detail/a_id/27/kw/privacy.  We will use information provided by the Parent to verify his or her identity; to contact him or her regarding his or her Child’s account and use of the App and, in our discretion, changes to App policies; and as otherwise described to in Justice’s website Privacy Policy. If a Parent does not provide his or her consent within a reasonable period of time, Justice will delete the Parent’s contact information.

 

PARENT'S RIGHTS; CONTENT REMOVAL

 

Parents have the right to review and request that Justice delete any Personal Information that the App has collected and retained about their Child. If you would like to request that Justice delete any Personal Information Justice may have about your Child or if you would like to request that the App make no further collection of Personal Information from your Child, please contact Justice through the App’s “Contact Support” feature or by email at privacy@justiceretail.com. (For any such email request, please include “Justice App: Child’s Personal Information” in the subject line.)

 

As described above, Parents will receive email notifications and may also individually review and request the deletion of any photo or video the Child has posted, or may request the deletion of the Child’s App account entirely, by following the instructions in the notification email sent to the Parent when the Child posts a photo or video on the App or by following the links and instructions within the App itself (though the “Contact Support” feature). A Parent may have the option to opt-out of receiving such notification emails, as described within the notification email.  Should a Parent elect to opt-out of receiving these emails and later want to have his or her Child’s post(s) removed or App account deleted, (s)he may do so through the App as described above. (If a Parent wants to have his or her Child’s post(s) removed or App account deleted and the Parent has both opted out of post-notification emails and lacks access to the App on his or her Child’s device, (s)he may contact Justice by email at privacy@justiceretail.com. Any such email must include “Justice App: Content-Removal Request” in the subject line.)

 

In addition, a registered user of the App has the right to request the removal of certain content that (s)he has publicly posted on the App.  As discussed above, a user may remove a post at any time or may delete her account entirely by following the links and instructions within a notification email sent to her Parent or within the App. A registered user may also request that a post be removed or her account deleted by sending an email to  privacy@justiceretail.com. You must put the statement "Justice App: Content-Removal Request” in the subject field of your email. In some cases, we may remove only your Personal Information but maintain the rest of your user content. Note that removal of public postings does not ensure complete or comprehensive removal of the content or information posted.

 

LINKS TO OTHER ONLINE SERVICES

 

The App may contain links to third-party websites that Justice does not control.  We are not responsible for the privacy or data collection practices of any third party.

 

CONSENT TO TRANSFER

 

If you are located outside of the United States, please be aware that information we collect may be transferred to and processed in the United States. By using the App, or providing us with any information, you fully understand and unambiguously consent to the collection, transfer, processing and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.

 

SECURITY

 

Justice has established and maintains reasonable procedures to protect the confidentiality, security, and integrity of Personal Information collected from users of the App. We also take reasonable steps to release Children's Personal Information, if any, only to service providers and third parties who are capable of maintaining the confidentiality, security and integrity of such information, and who, as described above, have agreed that they will maintain the information in such a manner.

 

CHANGES TO OUR POLICY

 

Justice may update this Privacy Policy at any time and any changes will be effective upon posting (unless otherwise specified). Your continued use of the App after the effective date of the revised Privacy Policy (or such other act as specified in the revised Privacy Policy) will constitute your consent to those changes. If we make any material changes in the way we use Personal Information, we will update the "Effective Date" above and we will display a notice on the App. We may also provide notice to you in other ways in our discretion. However, we will obtain parental consent prior to using or disclosing Personal Information in a manner materially different from the Privacy Policy posted at the time of collection and any prior parental consent received.
